Terms of Service

These terms govern your use of the PerkHour consumer app and the PerkHour retailer and administration portal (together, the “Service”) provided by PerkHour Inc. By using the Service you agree to these terms.

Accounts

  • You must be at least 18 to create a retailer account and at least 13 to use the consumer app.
  • You are responsible for activity under your account and for keeping your sign-in details secure.
  • Retailer accounts may be placed in a provisional state until PerkHour verifies the business. We may decline or suspend accounts that provide false information.

Deals and redemptions

  • Deals are offered by retailers, not by PerkHour. The retailer sets the offer, its schedule, its redemption radius within platform limits, and any usage limits.
  • A redemption ticket is valid only for the time shown on it and only at the store that issued the deal. Tickets are single use and are recorded with a unique transaction id.
  • Retailers must honor a valid ticket presented within its validity window and must not publish misleading offers.
  • PerkHour does not process payments. Any purchase takes place directly between you and the retailer.

Acceptable use

You agree not to misuse the Service, including by spoofing location, sharing or reselling tickets, scraping, interfering with other users, or attempting to access accounts or data that are not yours.

Retailer content

Retailers keep ownership of the content they publish and grant PerkHour a license to display it in the Service. Retailers are responsible for the accuracy and legality of their listings and offers.

Availability and changes

The Service is provided as is. We may change or discontinue features, and we may suspend accounts that violate these terms. We will give reasonable notice of material changes to these terms.

Liability

To the extent permitted by law, PerkHour is not liable for indirect or consequential losses, or for the acts of retailers or other users. Our total liability for any claim is limited to the amount you paid us for the Service in the twelve months before the claim, if any.

Governing law

These terms are governed by the laws of the State of New York, and disputes will be resolved in the courts located in New York County.
